NC sellers often worry about whether they have all the paperwork needed to actually close on a house sale. The short answer is most of what the closing attorney needs comes from public records and lender statements. The seller has to provide some specific documents, but the list is shorter than most sellers expect.
What the Seller Must Provide
Government issued photo ID, typically a driver’s license or passport. The deed showing how the seller acquired the property. If the deed cannot be found, the closing attorney can pull it from the appropriate county Register of Deeds. Mortgage information including lender name, account number, and current monthly statement. The closing attorney uses this to request a payoff statement. Any homeowner’s association documents if the property is in an HOA. Recent property tax statements. Any liens, judgments, or court orders affecting the property that the seller knows about.
What the Closing Attorney Pulls
The NC closing attorney handles most of the document gathering. Title search through the appropriate county Register of Deeds. Lien search through court records. Property tax verification through the county tax office. Mortgage payoff through direct communication with the lender. Any HOA documents through the management company.
Special Situations
Inherited property requires Letters Testamentary or Letters of Administration from the appropriate county Clerk of Court. Estates in probate require the probate file information. Property held in trust requires trust documents and trustee identification. Out of state sellers may need additional notarized documents that can be signed remotely.
Lost or Missing Documents
Most missing seller documents can be reconstructed by the closing attorney. Lost deeds are pulled from Register of Deeds records. Lost mortgage statements are obtained from the lender. Estate documents are pulled from the Clerk of Court. The closing attorney’s job includes solving these problems.
